JDT WITHIN SIGHT OF 8TH SUPER LEAGUE TITLE

PETALING JAYA, Aug 8 – Two goals in three minutes by Brazilian ace Bergson da Silva in the first half for a 2-0 win over Sabah FC and there is no stopping Johor Darul Takzim (JDT) in their bid to win the Malaysian Super League title for the eighth successive time.
The Southern Tigers with 45 points from 18 matches is a clear “Catch Me If You Can” message to their rivals with Terengganu FC second on 37 points from the same number of matches.
It was a JDT show at the Sultan Ibrahim Stadium in Iskandar Puteri, Johor Bahru on Sunday night with Bergson opening the scoring on 19 minutes off an assist by international Safawi Rasid.
He completed his brace two minutes later -this time beating Sabah custodian Rozaimie Rohimi from a long ball by Leandro Velazquez. The Southern Tigers could have added to their tally but muffed the opportunities that they created.
Penang is in third spot with 31 points from 17 matches after a 2-1 win over Melaka United at the City Stadium on Saturday which saw a dramatic finish in injury time.
The Panthers had gone ahead on 75 minutes when Brazilian Rafael Vitor netted from the penalty spot. Visitors Melaka United snatched the equaliser in the 90th minute.
Tajikistan midfielder Sheriddin Boboev, however, turned hero for Penang when he blasted an unstoppable shot three minutes into added time.
At the UiTM FC Stadium in Shah Alam on Saturday, UiTM FC scored their first win in 17 matches and added more misery over beleaguered Perak FC.
The university side won 2-0 with goals by Sean an Gianelli (30th) and Syafiq Al-Hafiz (74th). Despite the win UiTM FC remained at the bottom with five points. Perak is a rung above UiTM FC wit 13 points from 18 matches.

THE OLYMPIC GOLD REMAINS A DREAM AS AZIZULHASNI WINS SILVER

KUALA LUMPUR, Aug 8 – Malaysia’s elusive Olympics gold remains a distant dream when the country’s top cyclist Datuk Azizulhasni Awang could only deliver a silver medal in the men’s keirin final at the Tokyo 2020 Olympics on Sunday.
The 33-year-old Dungun-born Azizulhasni, a former world champion, had gone to Tokyo with confidence and had vowed to bring back a gold medal from Tokyo. However, it was not to be for Azizulhasni and company.
Was it over-confidence? Was it wrong strategy when it mattered most? It is left to be digested by Malaysians as the country’s hunt for gold goes on. It is another three year wait – this time the the Paris Olympics in 2024.
Defending champion Jason Kenny of Great Britain wrote another chapter in the Olympics and his illustrious career in cycling is expected to continue in Paris. Kenny, caught everyone by surprise with an explosive burst of speed which stunned his rivals.
The 33-year-old left his rivals trailing for his seventh Olympic gold, and it was left to Azizulhasni and Dutchman Harrie Layreysen to battle for the silver and the bronze. Azizulhasni pipped Lavreysen who had won the sprint gold for the silver.
For Azizulhasni, the silver is an improvement from his bronze medal at the Rio Olympics in 2016. He was sixth at the London Olympics (2012) after he made his debut at the Beijing Olympics in 2008.
Earlier, Shah Firdaus Sahrom, who took a nasty crash during the repecharge race on Saturday, failed to get into the semi-finals.

PANDELELA FLOPS WITH A LAST PLACE FINISH IN THE 10m PLATFORM FINALS

KUALA LUMPUR, Aug 5 – A disastrous first dive which garnered only 18 points – spelt disaster for Pandelela Rinong in the women’s 10m platform individual finals at the Tokyo 2020 Olympics on Friday and finished last.
The 28-year-old Sarawak-born Pandelela, never recovered from the first dive, although she recovered well in the second dive with an impressive score of 71.5 points.
Pandelela secured 60.80 in her third and 52.80 in the fourth and a poor 43.20 in the last for a total of 245.85 that was only enough for 12th and last place.
Earlier in the semi-finals Pandelela sneaked into the final round with a 12th place finish.
As expected, China once again ruled with dazzling performances from their teen sensations for a 1-2 finish in the medal hunt.
Fourteen-year-old Quan Hongchan was the darling at the Tokyo Aquatic Centre with near flawless dives. The judges credited her with scores of 96.00, 95.70, 96.00 and 96.00 for a high total score of 466.20 for the gold.
Compatriot Chen Yuxi, the reigning world champion and aged only 14, took the silver with 425.40 points. Australian Melissa Wu settled for the bronze with 371.40.
It was also disappointing day for Malaysia at the Izu Velodrome in Shizuoka as targeted medal hopes Datuk Azizulhasni Awang and Muhammad Shah Firdaus Sahrom failed to make the quarter-finals in the men’s sprint.

PANDELELA SURVIVES, HEARTBREAK FOR JUN HOONG

KUALA LUMPUR, Aug 4 – Malaysian diver, Pandelela Rinong, can thank her lucky stars as she sneaked into the semifinals in the women’s 10m platform individual event and it was a dramatic till the end of the preliminary round on Wednesday.
The Tokyo Aquatics Centre also witnessed the exit of another Malaysian hopeful when the Perak-born diver Cheong Jun Hoong could only manage a poor scored of 251.80 points to finish 26th in a field of 30.
Jun Hoong paid a heavy price with poor scores in the first two dives. Although she bucked up in the remaining three dives her scores were not good enough to pose a threat to others.
For the record Jun Hoong won the world title in Budapest in 2017. At the Rio Olympics five years ago she won the silver with Pandelela in the women’s synchronized 10m platform.
On Wednesday, Pandelela seemed to be on track with a top five finish after the first two dives but nerves got the better of her after that as she faded away.
In fact, while waiting for some divers to complete their final dive, Pandelela out of the top 18.
She rode on Brazilian diver Ingrid Oliveira’s slip to secure the last slot for the semis – an 18th place and stay alive.
The Sarawak-born Pandelela, who won a bronze at the 2012 London Olympics, remains Malaysia’s medal hope in the event after winning the World Cup in May. With a strong field in the Tokyo Olympics, over confidence could be disastrous for the Malaysian.
China remains strong favourite in the event. In the preliminary round the Chinese took the top two places.
Chen Yuxi, the 14-year-old sensation, topped the list with 390.70 points and compatriot second on 364.45. Delaney Schnell was third with 360.75.

AMBUSH MARKETING IN SPORTS: WHEN SPONSORS CRY ‘FOUL’

KUALA LUMPUR, Aug 3 – Malaysians were recently so excited about the achievements of our athletes competing in the Tokyo 2020 Olympics.

With billions of eyeballs around the world glued onto the event, there is a huge opportunity for sponsors to showcase their products and services for the masses.

With the Olympics Games being one of the most prestigious sport events in the world, the Olympic symbol has become one of the most recognisable brands globally.

Inevitably, the Games attract many big brands seeking to increase their exposure to consumers from over 200 countries and are willing to fork out multi-millions of dollars to be granted the exclusive rights to use the Olympic Games-related intellectual property (IP) and to marketing and advertising opportunities.

According to Managing Director of Adipven (M) Sdn Bhd, Ramakrishna Damodharan since Olympic sponsorship is expensive, some companies seek to avoid the financial obligations while still benefitting from the Olympic advertising spotlight by applying ambush marketing techniques.

Take German sportswear manufacturer, Puma for example. On March 24, 2020, on the day the Tokyo Olympics were announced to be postponed, Puma filed a trademark application to register “Puma Tokyo 2021” with the US Patent & Trademark Office (USPTO).

The trademark application was subsequently refused by the USPTO because of its potential link to the event.

Puma’s action may be seen by IP practitioners as “playing with fire”, whereas its rivals would have defined the bold decision as the act of “attacking from a hidden position”. Call it “piggyback marketing”, “parasite marketing” or “opportunistic advertising”, ambush marketing is here to stay. What Puma had up its sleeve is classic ambush marketing, for Puma is not an official Olympic sponsor.

With the Olympics taking place in Tokyo currently in full swing, this article will seek to define the term “ambush marketing”; how ambush marketing can lead to IP infringement; what are the remedies that an injured party (sponsors) can avail of and what lessons can be derived from ambush marketing from the perspective of intellectual property rights.

What is Ambush Marketing?

Ambush marketing is smart marketing because of its creative way to capitalise on big sporting events (think FIFA World Cup, Olympic, World Championship, SEA Games and even Sukma). It saves money because while other brands are paying huge fees for the rights to be part of the sporting programmes, non-sponsors use this opportunity to connect their product with a particular event without having to pay sponsorship expenses, instead, it cashes in on the media hype.

There are two types of ambush marketing; direct ambushes vs indirect ambushes. Direct ambushes happen when the actual IP rights; e.g. trademark, copyright, etc. of the event organiser are used to create the false impression that they are associated with an event.

The more difficult cases to spot are indirect ambushes, ones in which ambush marketers capitalises on the event without the misuse of the event’s trademarks or without making a direct false claim of affiliation with the event – this can include buying advertising space near the event and distributing free branded merchandise to the people present in the sporting event, just to name a few.

How can ambush marketing lead to intellectual property infringement?

Although a pretty tactical technique, ambush marketing is also a pretty illegal marketing stunt.

When sports events registered as trademarks, they become a brand in themselves, protected by the IP Code. Thus, by making it appear that their brands and products are affiliated with a major event or an athlete as a sponsor, ambush marketers commit trademark infringement of the rights of events as a brand in themselves. They cause “confusion as to sponsorship” – that is, as to affiliation, connection, or association of the goods or services of a person to another as to its origin, sponsorship, or approval.

Suppose the Olympic Games are hosted as “Tokyo Olympic 2020” which is a registered trademark. Anyone who intends to promote their business interests using the Olympic rings which are the exclusive property of the International Olympic Committee but without the authority from the IOC and not being an official sponsor thereof, would be liable for trademark infringement.

In the context of sports and sporting events, the following are recognised as intellectual property rights.

Copyrights:

Logos and mascots may be protected as “artistic works” whereas slogans may be protected as “literary works” and broadcasting rights

Trademarks:

Branding elements such as event names, team names, their respective logos, taglines, colour-schemes, emblems, etc.

Industrial designs:

Protects the aesthetic design of the product, not the functionality. Examples are mascot design, merchandise, footwear, apparel, equipment.

Patents

Promotes innovation and technological advancement resulting in inventing sporting devices, nutritional supplements, sporting goods, sport drinks, etc.

It is important to note however, that to seek recourse against IP infringements, it is thus necessary that an IP rights owner must have first registered his IP rights with the relevant IP Offices.

What are the remedies that an injured party or sponsors can avail of?

When a sponsor has paid dearly for exclusive advertising rights, it will want an immediate solution to prevent or stop a competitor from stealing that benefit and will look to the owner of the rights, the event organiser, to step in.

The single most important step a sponsor can take in anticipation of ambush marketing is to address it as a critical part of the sponsorship negotiation. Such steps can include, but not limited to:

a. Sponsorship agreement to impose obligations on the event organiser that includes protection for official sponsors;

b. Pre-event publicity by the organiser stating that ambush marketing will not be tolerated. Use of these IP rights without any permission and/or in any unauthorised way is therefore punishable by law;

c. Event organisers to launch educational campaigns to educate the public about the basics of intellectual property and ambush marketing.

If we see the laws made by different countries, we can see that a few countries have enacted strong laws against ambush marketing wherein prohibited acts include:

1. Placement of an advertisement on the outskirts of an event;

2. Alluding a protected event even if there is no proposal that the advertiser is a sponsor; and

3. To bring a product to the attention of people who are interested in the event.

Whilst the laws are there to protect the integrity of the sporting event as well as to safeguard the interest of the sponsors, non-sponsors use ambush marketing to market their own products and services. We have seen non-sponsors providing energy drinks, massages, consultancy etc. at the outskirts of the stadiums. This will give the impression to the audiences that these parties are indeed sponsors of the Games.

Whilst the international sports organisation like the IOC and sponsors take serious look at this issue and try various ways to tackle it, unfortunately ambush marketing has been there and unfortunately will continue to haunt them. Therefore, it is prudent for sponsors to have a holistic look on why they are sponsoring a sporting event, what they aim to achieve and who are the possible competitors who may conduct an ambush marketing.

Conclusion

The protection against ambush marketing is one of the most crucial aspects of IP rights in the sports sector. Although it is inevitable that event organisers will not be able to stop all ambush marketing efforts, the positive take-away is as evident from the on-going efforts to stop ambushers, where it encourages organisers and sponsors to work harder to thwart intellectual property violations and raises the awareness of IP rights globally – a long term benefit to all IP owners.

PERAK HIT FOR FIVE AGAIN AS PENANG WIN 5-3

PETALING JAYA, Aug 3 – Beleaguered Perak FC, who had rested head coach Chong Yee Fatt, suffered another humiliating defeat – this time at home – losing 5-3 to Penang FC in Tuesday’s Super League match played at the Perak Stadium in Ipoh.
Yee Fatt’s assistant Shahril Nizam Khalil, is the new man to helm The Bos Gaurus, however, it was another whitewash for the once powerhouse of Malaysian football.
Before the match against Penang, Perak were hammered 5-0 by Terengganu on July 24 and Johor Darul Takzim on July 31. Both matches were played away. In between, Perak managed to salvage a point with a scoreless draw at home on July 27.
Penang opened the floodgates as early as the first minute when Brazilian defender Rafael Vitor found the net. The Brazilian went on to score a hattrick with two other strikes in the eighth and 28th minutes.
Another Brazilian hot-shot Casagrande and Azim Rahim completed the rout with goals in the 21st and 88th minutes.
If there is any consolation for Perak it was the three goals they managed to score – all scored by Ghanaian striker Nana Poku with his first coming in the 15th minute before he netted two more from the penalty spot in the 36th and 58th minutes.
At the Hang Tuah Stadium in Melaka, Melaka United fell to a 1-0 defeat to Johor Darul Takzim. The Southern Tigers netted in the second minute from the penalty spot after Gonzalo Cabrera was felled in the box by Akmal Zahir.
Brazilian striker Bergson da Silva no mistake from the spot to beat Melaka custodian Khairul Fahmi Che Mat.
Selangor FC defeated UiTM FC 2-0 at the Petaling Jaya Stadium for their second successive win, having beaten Penang 4-1 away in their last match. Shahrul Nazeem Zulpakar and Ifedayo Olusegun scored the 26th and 57th minutes respectively.

PERAK FOOTBALL IN A MESS

PETALING JAYA, Aug 3 – Perak FA president Datuk Muhammad Yadzan Mohammad has called on head coach Chong Yee Fatt to be rested – with hopes that Perak football fortunes will take a turn for the better.
At the same time Yadzan is is keeping his fingers crossed that the Bos Gaurus will be hoping to avoid relegation to the lower tier Premier League.
However, Yadzan forgot that it is not the coach who is responsible for Perak’s present predicament.
It is Perak’s off football woes that have cracked open Perak football. Finding a scapegoat to cover the folly of the management is always the shortcut in Malaysian football.
Late payment of salaries stand out like a sore thumb in Malaysian football and Perak has not escaped this sickening ”football disease” in the country.
This has affected the welfare of the players who have families to take care and other commitments as football is their livelihood.
It did come as a surprise there has been a mass exodus of Perak players and it has crippled the Perak team. In fact, Yee Fatt deserves a pat on the back for being able to make do with whatever material he has to field a team.
For the record, Yee Fatt was not the head coach of the team for the new season. He took over reins from Mehmet Durakovic when the Australian ran into snags with the management over his existing contract.
When both parties could not come to an amicable solution, the former Australian called it quits and returned home – citing family commitments as his reasons.
Big names in Perak football like Guilherme de Paula, Shahrul Saad, Kenny Pallraj, J. Partiban have all moved to greener pastures for survival. Brazilians Leandro Dos Santos and Careca left the team at the end of last month.
Last Saturday (July 31) was a double blow for Perak football when the Bos Gaurus and their feeder squad (Perak 2) suffered embarrassment with crushing defeats.
The senior team was whacked 5-0 by seven-time Malaysian Super League champions Johor Darul Takzim (JDT) at the Sultan Ibrahim Stadium in Iskandar Puteri, Johor Bahru while Perak 2 was hammered by a similar margin by Negri Sembilan in a Premier League at the Stadium Tuanku Abdul Rahman in Paroi, Seremban.
Incidentally, both the Perak teams are lying second from the bottom in their respective leagues with relegation staring at them.

DHABITAH’S BEST NOT GOOD ENOUGH FOR A PODIUM FINISH

KUALA LUMPUR, Aug 1 – Her captivating smile after each dive spoke of her consistent overall performance in the women’s 3m springboard diving final at the Tokyo 2020 Olympics but Malaysian hope Nur Dhabitah Sabri missed out on a podium finish.
The 22-year-old Malaysian finished fourth in the final with 326.15 points. Chinese divers clinched a 1-2 finish in the final at the Tokyo Aquatics Centre with Shi Tingmao taking gold with 383.50 and compatriot Wang Han the silver with a 348.75 total. Krysta Palmer of the United States took the bronze with 343.75.
This is Dhabitah’s second Olympics after finishing in ninth place in the 10m platform individual at the Rio Olympics in 2016.
”I enjoyed my dives and I am satisfied with my overall performance. I was fully focused and gave my best. That matters to me. The rest is out of my jurisdiction,” said a smiling Dhabitah.
In the same breath Dhabitah added that it was a “tough mission with many obstacles” in this year’s Olympics, especially the coronavirus pandemic.

BRONZE MEDAL SAVES BADMINTON FROM EMBARRASSMENT IN TOKYO

KUALA LUMPUR, July 31 – Malaysia celebrated their first medal at the Tokyo 2020 Olympics and it came from badminton when Aaron Chia-Soh Wooi Yik came from a game down to defeat Indonesia’s Hendra Setiawan-Mohammad Ahsan 17-21, 21-17, 21-14 for the bronze medal in the men’s doubles.
While the bronze medal achieved in a 52-minute encounter did not come easy, it certainly saved Malaysian badminton the blushes from returning home without a medal after an all-time high of three silver medals in the Rio Olympics five years ago.
Malaysia won the silver medal in Rio in the men’s singles (Datuk Lee Chong Wei), Goh V Shem-Tan Wee Kiong (men’s doubles) and Chan Peng Soon-Goh Liu Ying in the mixed doubles.
If we are to take the bronze medal effort by Aaron-Wooi Yik in account, it simply means that Malaysian badminton is on a slide.
Malaysian badminton is losing its grip in the shuttle sport while other nations have improved by leaps and bounds.
The tears shed by Aaron and Wooi Yik after the bronze medal spoke of their feelings they endured in Tokyo. They were hailed as gold medal prospects after their stunning 21-14, 21-17 over Indonesia’s top seeds Marcus Fernaldi Gideon-Kevin Sanjaya Sukamuljo.
However, failed to ride on their momentum in the semi-finals and lost 22-24, 13-21 to China’s former world champions Li Jun Hui-Liu Yu Chen.
The bronze medal playoff was a tremendous effort by the Malaysians who had lost 16-21, 19-21 to Hendra Setiawan-Mohammad Ahsan in a Group D match.
It could be tears of joy or tears of frustration. Joy for winning the bronze medal and frustration for not being able to make the final.
It was a case of so near yet so far – that summed up their topsy turvy run in Tokyo. Still the bronze medal counts in many ways for the game and the nation.
Kudos to the pair for saving Malaysian badminton from embarrassment in Tokyo. Badminton was a gold medal target after Lee Zii Jia won this year’s All-England in March.
Much hope was pinned on the 23-year-old Kedah-born Zii Jia but he failed to make the quarter-finals following a 8-21, 21-19, 21-5 defeat to reigning Olympic champion Chen Long of China.
